Terms of Service

1. Acceptance

By using rushburgers.co.ke, placing an order, or creating a My Rush account, you agree to these terms. If you do not agree, do not use the service.

2. Who we are

Rush Burgers is a delivery-only food brand based in Nairobi, Kenya. We operate from Timau Plaza, Argwings Kodhek Road, Kilimani. All orders are prepared and delivered from this location.

3. Orders

• Orders placed through rushburgers.co.ke are subject to availability and menu hours (10:30–22:30 daily, unless changed by us).
• Prices are listed in KES and include VAT where applicable.
• Delivery fees vary by area and order size. Free delivery applies on orders above the displayed threshold.
• Payment is accepted via M-PESA on delivery, card on delivery, or cash on delivery.
• We reserve the right to cancel or refuse orders at our discretion, including in cases of suspected fraud or misuse.

4. Delivery

• We deliver within Nairobi. Delivery areas are listed at checkout and may change without notice.
• Estimated delivery times are approximate and not guaranteed. Traffic, weather, and demand may affect timing.
• You are responsible for providing an accurate delivery address. Redelivery due to incorrect addresses may incur an additional fee.
• Orders not collected within a reasonable time after arrival may be disposed of.

5. Account & My Rush

• Creating a My Rush account is optional. You may also order as a guest.
• Accounts are identified by email address. You are responsible for keeping your login credentials secure.
• One account per person. Creating multiple accounts to exploit promotions, birthday rewards, or referral bonuses is prohibited and may result in account suspension.
• You may delete your account at any time from My Rush settings. Deletion is permanent and cannot be undone.

6. Rush Club & Rewards

• Rush Club is free to join. Membership is non-transferable.
• Member Fridays offer member pricing on select items. Availability may vary.
• The Secret Build is a rotating off-menu item available to members only, while supplies last.
• Birthday reward: One free birthday burger per member per calendar year. The reward is for the burger only — delivery fees are paid by the customer. To claim, your birthday must be saved in your profile before your birthday date. You cannot change your birthday after the reward has been claimed for the current year. Rush Burgers reserves the right to verify birthday claims and deny rewards suspected to be fraudulent.
• Leaderboard rewards (50% discount codes) are issued at our discretion and expire if unused.
• Rewards have no cash value and cannot be exchanged for money.

7. Promotions & Codes

• Promo codes are single-use unless stated otherwise.
• Codes cannot be combined, sold, or transferred.
• We may revoke codes obtained through unauthorised channels.
• Minimum order thresholds apply to promo codes as displayed at the time of issue.

8. Cancellations & Refunds

• You may cancel an order before it enters preparation. Once preparation begins, cancellation is no longer possible.
• If your order is incomplete, incorrect, or arrives damaged, contact us within 30 minutes of delivery. We will investigate and, at our discretion, offer a replacement or credit.
• Refunds, where applicable, are processed to the original payment method within 7 business days.

9. Intellectual property

All content on rushburgers.co.ke — including the name "Rush Burgers", logos, menu descriptions, photography, and code — is owned by Rush Burgers and protected under applicable intellectual property laws. You may not copy, reproduce, or use any content without written permission.

10. Limitation of liability

To the fullest extent permitted by Kenyan law, Rush Burgers shall not be liable for any indirect, incidental, or consequential damages arising from the use of our service, including but not limited to delayed deliveries, food allergies, or third-party payment processing issues. Our total liability for any claim shall not exceed the value of the order in question.

11. Changes to these terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms. We will notify material changes via email or on the website.

12. Governing law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
